DeviceBench is a product name of, and is operated by, Elowin Labs LLC. References to "DeviceBench", "we" or "us" mean Elowin Labs LLC doing business as DeviceBench. By using the website at devicebench.io, the hosted lab, or the local companion, you agree to these terms and to the privacy policy. If you do not agree, do not use DeviceBench.

1. What DeviceBench is

DeviceBench is a free tool that detects the on-device AI models a machine can run, runs tasks on them, and reports timing and system load. Every model runs on your own hardware, in your browser or through runtimes you have installed. DeviceBench does not host models, does not process your prompts on a server, and does not provide model output of its own. Results are produced by third-party models and runtimes and can be wrong, incomplete or unsuitable for a purpose; you are responsible for how you use them.

2. The local companion

The companion is software you download and run on your own computer. You may run, inspect and modify it on machines you control. You are responsible for keeping your system, your model runtimes and the models you pull up to date and appropriately licensed. Models fetched by Ollama, LM Studio, WebLLM, Chrome or Apple are governed by their publishers' licences, not by these terms.

3. Acceptable use

You may use DeviceBench for any lawful purpose, including commercial evaluation. You may not use it to interfere with the website, to circumvent rate limits or security of the site or of a model publisher, or to attack other systems. You alone are responsible for the prompts you run and for anything you do with the output.

4. Measurements

Timing, throughput and load figures depend on your hardware, on what else is running, on the runtime version and on the model build. The lab labels which figures come from the runtime and which are estimated. They are provided for comparison and are not a guarantee of performance, and we are not liable for decisions made on the basis of them.

5. Intellectual property

The DeviceBench name, logo, website design and copy belong to Elowin Labs LLC. The companion's source code is provided for you to run and inspect on your own machines, under the same as-is terms. Model names and runtime names belong to their respective owners and are used for identification only.

6. Third-party services

Running a model for the first time can cause your browser or runtime to download it from its publisher (Google, Hugging Face, Ollama, Apple and others). Those downloads and the models themselves are subject to the publisher's terms. We do not control those services and are not responsible for their availability or content.

7. Disclaimer of warranties

DEVICEBENCH IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR THAT ANY MEASUREMENT IS ACCURATE.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ELOWIN LABS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF DEVICEBENCH. BECAUSE DEVICEBENCH IS FREE, OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO ONE HUNDRED US DOLLARS (USD 100).

9. Children

DeviceBench is not directed at children under 13 (or a higher minimum age where local law requires one). We do not knowingly collect personal data from children; the site collects none from anyone, as the privacy policy explains.

10. Changes

We may update these terms as the product changes. The date at the top reflects the last material change. Continued use after a change means you accept the updated terms.

11. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Palm Beach County, Florida, and you consent to their jurisdiction. If you are a consumer in a jurisdiction whose law gives you rights that cannot be waived by contract, nothing in these terms limits those rights.
